Well, yes, many a man has had to pay up for this and many a woman has grinded men for it and many a child has felt that he/she has been done in by all of the adult problems that has been rained upon them ~ we all know what that is about.
Now, in most cases the court stipulates that the maintenance is payable up untill the child/children reaches the age of 18 or 21 and in extreme cases the financial liable party also has to pay for uni fees. In a lot of instances, mothers have been desperate and have taken their way back to court in order to get a magistrate order to claim said alimony from the fathers pay.
Now my question : who is liable to see that such court order is adhered to and that such alimony payments cease to be paid at the indicated date, as stipulated in the original court order?
Main reason why I am asking this ~ I had a client in my office this morning who said he thinks it is about time that he stopped paying alimony to his 29yr old son. I inspected his payslip --- any yes, there it was indicated - the magistrate order to the amount of X ..........
I instucted him to immediatly go to the court and get a proof of the original order, and then ask the judge to immediatly issue a summons to instruct the salary department of his job to stop the deductions.
Don't know how many of you out there have the same thing going, but please take note that your salary department has clear instructions on things like this and that they know when to stop deducting, for in the end of the day you will not get refunded for incorrect deductions .....
Gee I wish I had the court place a garnishee order on my dad's paypacket until I was 29! Nice free beer for a near 30 year old.
Did the son protest when payments stopped?
Robert - the payment has not stopped yet. I only saw the client today and said he had to go to the courts as soon as possible in order to get it stopped, so there is a surprise awaiting the son .......
I reckon the son will sue for loss of earnings and the reinstatement of that to which he became accustomed and received continuously until he nearly reached mid-life.
In SA you need to give 2 weeks notice to all parties involved.
I hope he return a favour to his son when he reaches a ripe old age.
